1. Program Description & Sender Identification
LocalSites ("we," "us," "our") operates an SMS/text messaging program to communicate with current and prospective clients regarding our web design, hosting, and digital marketing services for local businesses.
Messages may include:
- Appointment and consultation reminders
- Project status updates and milestones
- Service notifications (hosting, maintenance, renewals)
- Promotional offers and seasonal discounts
- Important account and billing notifications
- Follow-ups to inquiries submitted through our website or other channels
All messages will identify LocalSites as the sender.
2. Consent & Opt-In
By providing your mobile phone number and expressly consenting to receive text messages from LocalSites — whether through our website contact form, a verbal agreement, or any other opt-in mechanism — you are providing your prior express written consent to receive recurring automated text messages from LocalSites at the phone number you provided.
Important: Consent is not a condition of purchase. You are not required to opt in to SMS messaging to use our services or make a purchase. Your consent applies solely to communications from LocalSites and cannot be shared with or used by any third-party sender, in compliance with the FCC's one-to-one consent rule effective April 11, 2025.
How We Obtain Consent
- Website Forms: By checking an unchecked opt-in checkbox on our contact or quote request forms and submitting the form.
- Keyword Opt-In: By texting a designated keyword (e.g., "START" or "JOIN") to our business number.
- Verbal Consent: By verbally confirming your consent during a phone call, which will be documented.
Pre-checked boxes are never used. All opt-in mechanisms require an affirmative action on your part.
3. Message Frequency
Message frequency varies based on the nature of our communications with you. You may receive:
- Transactional messages: As needed (appointment reminders, project updates, account notifications)
- Promotional messages: Up to 4 messages per month
We will never exceed a reasonable volume of messages. The exact number of messages you receive depends on your interactions with our services and the status of any active projects.

LocalSites does not charge any additional fees for sending or receiving SMS messages. Contact your mobile carrier for details about your messaging plan and any associated charges.
5. Opt-Out Instructions
You may opt out of receiving text messages from LocalSites at any time using any of the following methods:
- Text "STOP": Reply STOP to any message you receive from us. You will receive a one-time confirmation message and no further messages will be sent.
- Text "UNSUBSCRIBE": Reply UNSUBSCRIBE to any message.
- Email: Send an opt-out request to hello@localsites.biz with the subject line "SMS Opt-Out" and include the phone number you wish to unsubscribe.
- Phone: Call us at (555) 123-4567 and request to be removed from our SMS list.
- Any reasonable method: In compliance with TCPA regulations, we honor opt-out requests made through any reasonable means, including informal messages such as "stop texting me," "remove me," "leave me alone," or similar language.
After opting out, you will receive a single confirmation message. No additional messages will be sent unless you re-subscribe. Opting out of SMS does not affect other communication channels (email, phone calls) unless you separately request that as well.

7. Messaging Hours
In compliance with the Telephone Consumer Protection Act (TCPA), we will not send text messages before 8:00 AM or after 9:00 PM in the recipient's local time zone. We also observe stricter state-specific quiet hours where applicable, including but not limited to:
- Alabama & Louisiana: Messages sent only between 8:00 AM and 8:00 PM; none on Sundays or legal holidays.
- Mississippi: No messages on Sundays.
- South Dakota: Messages sent only between 9:00 AM and 9:00 PM Monday–Saturday; none on Sundays.
- Oklahoma: No messages on Sundays.
- Florida: In compliance with the Florida Telephone Solicitation Act (FTSA), including all applicable restrictions on frequency and timing.
- Texas: In compliance with Texas Senate Bill 140 (effective September 1, 2025), including all provisions governing marketing text messages.
We continuously monitor and comply with updated state and federal regulations regarding permissible messaging hours.
8. One-to-One Consent Compliance
In accordance with the FCC's updated rules effective April 11, 2025, consent provided to LocalSites applies only to messages from LocalSites. Your consent is never sold, transferred, shared, or otherwise provided to any third party for their own messaging purposes. Any messages you receive from us will be directly related to the context in which you originally provided your consent (e.g., the specific service inquiry or sign-up form).
9. Privacy & Data Protection
Your phone number and related information are protected under our Privacy Policy. Specifically regarding our SMS program:
- Your phone number will not be sold, rented, or shared with third parties for marketing purposes.
- We may share your number with our SMS service provider solely for the purpose of delivering messages on our behalf.
- Your data is stored securely and accessed only by authorized personnel.
- We retain opt-in and opt-out records as required by law for compliance documentation.
10. Record-Keeping
We maintain detailed records of all consent obtained, including:
- The date and time consent was provided
- The method by which consent was obtained (web form, keyword, verbal)

12. Supported Carriers
Our SMS program is supported on all major US wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, Metro PCS, US Cellular, and others. Carrier-imposed message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
13. Age Restriction
Our SMS messaging program is intended for individuals 18 years of age or older. By opting in, you confirm that you are at least 18 years old.
14. Disclaimer of Liability
LocalSites and mobile carriers involved in the delivery of SMS messages are not liable for:
- Delayed or undelivered messages due to carrier network issues
- Inaccuracies in information caused by technical errors
- Charges incurred by your carrier for SMS/MMS messaging
- Service interruptions outside of our control
15. Changes to This Policy
We may update this SMS policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued participation in our SMS program after any changes constitutes your acceptance of the revised policy.
